This Guest Release and Waiver of Liability (“Waiver”) is executed by the undersigned guest (“Guest”) in favor of Villagio Luxury Shops and Hotel, also known as Villagio Boutique Hotel, its owners, affiliates, agents, employees, managers, successors, and assigns (collectively, “Villagio”).
1. Acknowledgment of Risk: Guest acknowledges and understands that the use of hotel and retail property amenities, including but not limited to lodging accommodations, retail spaces, parking areas, Rocco's Ristorante by Villagio, The 1864 Club by Villagio, court yard and other common areas, may involve certain inherent risks, including but not limited to personal injury, illness, property damage, or loss. Guest voluntarily assumes all such risks.
2. Release and Waiver: In consideration of being permitted to enter and use the facilities of Villagio, Guest hereby voluntarily releases, waives, and discharges Villagio from any and all claims, demands, causes of action, or liability of any kind arising out of or related to Guest’s stay, presence, participation in any activity, or use of the premises, including claims for injury, loss, illness, or property damage, whether caused by negligence or otherwise.
3. Indemnification: Guest agrees to indemnify and hold harmless Villagio from any and all claims, actions, damages, costs, and expenses (including attorneys’ fees) arising from or relating to Guest’s actions, conduct, or negligence while on the premises.
4. Property and Valuables: Guest acknowledges that Villagio is not responsible for loss, theft, or damage to any personal property or valuables brought onto the property, including in rooms, vehicles, or public spaces.
5. Health and Conduct: Guest certifies that they are in good health and will not engage in any activities on the premises while under the influence of drugs or alcohol or in a manner that endangers others. Guest agrees to follow all posted rules and any instructions provided by staff. No outside alcoholic beverages are permitted on the property.
6. Photography and Media: Guest grants Villagio the right to use any photographs or videos taken on the premises for promotional purposes, unless Guest provides written notice requesting otherwise.
7. Governing Law: This Waiver shall be governed by and construed in accordance with the laws of the State in which the property is located.
8. Severability: If any portion of this Waiver is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
BY Checking In, Guest acknowledges that they have read and understand this Waiver, accept and assume all risks, and agree to release Villagio from all liability as stated above.
